The Supreme Court has passed orders for issuing notices to Secretary, Ministry of Road Transport and Highways, Special Land Acquisition Officer and Competent Authority, National Highways Authority of India NH 75(48), The Project Director, National Highways Authority of India, Deputy Commissioner and Arbitrator, Hassan District based on a plaint filed by BD Vivek, a resident of Thotadagadde Estate, Sakaleshpur regarding matter related to determination of compenstation towards land acquired from farmers.
In the petition filed before the Supreme court under Article 32 , the constitutional validity of section 3 G and 3 J of the National Highways act is challenged and the Supreme Court has ordered issuance of notice to respondents. The challenge is about the appointment of Deputy Commissioner as an arbitrator in compensation related matters and also with regards to the parameters to be followed for determination of compensation towards lands acquired from farmers .
