HC advises TN to consider an open-air jail for women

The Madras High Court has directed Tamil Nadu to evaluate the proposal for establishing at least one open-air jail exclusively for women. This decision comes following a Public Interest Litigation filed by Raja from Madurai, who challenged the exclusion of women prisoners from open-air jails under Rule No. 797(9) of the Tamil Nadu Jail Rules, 1983.

The PIL highlighted that Tamil Nadu operates several jails, including three open-air jails for men, which offer opportunities for rehabilitation and employment. The petitioner argued that a similar facility should be available for women prisoners to aid their reintegration into society.

In response, the court instructed the state government to seek expert opinions on the matter and consider the petitioner’s request. The court noted that, although rules were amended in 2021 to address this issue, no decision had been made regarding the establishment of a women’s open-air jail. The judges emphasized the need for a thorough review before issuing a decree and directed the Home Secretary to assess the situation. Consequently, the petition was dismissed.
