Seats In MBBS Course At AIIMS Are Not For Sale, Says Delhi HC

On Wednesday, the Delhi High Court denied an appeal against a Karkardooma court order. The trial court declined to issue an order recouping the money paid to reserve a spot in the AIIMS MBBS program.

The AIIMS MBBS course seats are not for sale, according to the high court. The appeal filed by Vimmi Chawla to overturn the ruling of the Additional District Judge (ADJ-East) Karkardooma Court in New Delhi was denied by Justice Jasmeet Singh.

The bench stated that the evidence paints a very poor picture. The appellant filed the lawsuit to get the money he paid to get his daughter admitted to AIIMS back. It was claimed that Deepak Sethi, the defendant, had deceived the petitioner about the amount of money needed to gain admission to AIIMS. The respondent communicates with higher officials and the ministry of health.

The suit was filed because it was claimed that the respondent was unable to gain admittance despite having paid the money. The bench noted that the ADJ had dismissed the suit, stating that the court could not intervene on behalf of an illegal act. According to Section 23 of the Indian Contract Act, the court declared that the parties agreement was null and void from the beginning and that recovery was not permitted. The appellant may be naive, but this court cannot support someone who has engaged in the above-mentioned illegal activity, the high court ruled.
