Court Upholds Confiscation Of Properties Valued At Rs 2 Crore In Fraudulent Scheme Case

The designated Court under the Odisha Protection of Interests of Depositors (OPID) Act in Cuttack has recently issued an order confirming the attachment of properties worth approximately Rs 2 crore belonging to M/s Surya Nirman Resources (P) Ltd. and its directors. The ruling, issued on October 17, is linked to a case (11/2017) that was filed by the Economic Offence Wing (EOW) of Odisha Police. According to sources from the EOW, M/s Surya Nirman Resources (P) Ltd., along with its directors and staff, managed to amass deposits exceeding Rs 2 crore from more than 100 investors between 2010 and 2015. The investors were enticed by promises of acquiring plots in the Chandaka area, backed by alluring schemes and high returns. However, the company failed to deliver on its commitments, leaving the investors without the promised plots or returns on their investments. Subsequently, based on a complaint lodged by Bidhu Bhusan Mohanty, the EOW initiated legal action against the company and its key figures, including MD Chinmay Mallick and Directors Rojalin Mallick and Biswajit Pattnaik. During the investigation, the EOW gathered information on the company’s and directors’ assets, including extensive landed properties in Krushna Nagar, Chandaka, Kantabada in Khordha District, and Kujanga & Padampur in Jagatsinghpur District.

The EOW’s pursuit of justice led to the proposal for the attachment of the properties under the OPID Act, which was subsequently approved by the state finance department. The properties were finally confiscated on April 9, 2018, following the court’s recent confirmation of the attachment order. This development marks a significant step forward in ensuring accountability and justice for the affected investors.
