The Urban Development Department has ordered the cancellation of all allotment orders issued for alternative sites in violation of the Government directive dated March 14, 2023.
In a communication, the Under Secretary to the Government, Urban Development Department (Development Authorities and NAYOSE), directed the concerned authorities to cancel all allotments of alternative sites made contrary to the Government’s instructions contained in Government Letter No. NAE 71 MYAPRA 2023(E), dated March 14, 2023.
The Government has also directed authorities to initiate legal action by filing civil suits for cancellation of Sale Deeds relating to alternative sites that have already been registered at the offices of Sub-Registrars in violation of the directive.
In cases where Sale Deeds have not yet been executed, the concerned development authorities have been instructed not to execute such deeds until the Government frames appropriate guidelines and issues further directions.
The Government has further ordered that suitable instructions be issued to the Mysuru City Corporation and the concerned municipal councils or gram panchayats to withhold the issuance of khatas for alternative sites that have already been registered with the Sub-Registrar.
In cases where khatas have already been issued, the concerned local bodies have been directed to take action for their cancellation in accordance with the provisions of the Karnataka Municipal Corporations Act, 1976; Karnataka Municipalities Act, 1964; and Karnataka Gram Swaraj and Panchayat Raj Act, 1993, as applicable.
The Urban Development Department has also instructed the authorities to strictly implement the directions issued in accordance with the recommendations of the High-Level Technical Committee and submit a compliance report to the Government.
The latest directive is expected to have significant implications for alternative site allotments made by development authorities, particularly where such allotments are found to have bypassed or violated the Government’s prescribed norms.
