HC grants time to Swamy in Citizenship petition

The Delhi High Court granted BJP leader Subramanian Swamy time to submit a copy of a petition pending before the Allahabad High Court regarding Congress leader Rahul Gandhi’s citizenship. Swamy informed the court that he had obtained the petition copy and stated that the prayers in the case differ from his own.

A bench, led by Chief Justice Manmohan, instructed Swamy to file documents electronically, as previously ordered. The plea was scheduled for further hearing on November 6. Swamy’s petition seeks directions to the Ministry of Home Affairs (MHA) to decide on his request for the cancellation of Gandhi’s Indian citizenship.

Swamy also asked the MHA for a status report on his representation against Gandhi, who is the Leader of the Opposition in the Lok Sabha. Swamy asserted that the pending case in Allahabad is unrelated to his own.

The bench noted that another petition on a similar matter was being reviewed by the Allahabad High Court, emphasizing that two courts cannot address the same issue simultaneously. Earlier, the Lucknow bench of the Allahabad High Court asked the Centre about any decision made on a representation under the Citizenship Act concerning allegations against Gandhi. Swamy’s plea claimed that Gandhi’s actions violated the Constitution and the Indian Citizenship Act.
