SC permits green cracker production, Sale in Delhi banned

The Supreme Court on Friday allowed the manufacturing of green firecrackers in the Delhi-NCR region, with the strict condition that they cannot be sold in the National Capital Region. A bench comprising Chief Justice BR Gavai and Justices K Vinod Chandran and NV Anjaria permitted certified manufacturers—those approved by NEERI and PESO—to produce green crackers, provided they submit an undertaking not to sell them in prohibited areas. The matter has been posted for further hearing on October 8.
The court directed the Centre to propose a revision of the existing ban on firecracker manufacturing after consulting all stakeholders, including the Delhi government, manufacturers, and sellers. The bench noted that a complete ban may not be practical, citing past experiences where strict bans were ineffective. As an example, it referred to illegal mining mafias in Bihar that emerged despite a total ban on mining, highlighting the need for a balanced approach.
During the hearing, amicus curiae Aparajita Singh argued for a total ban, warning that allowing manufacturing could lead to crackers being sold and used in banned areas. On the other hand, manufacturers’ lawyers requested permission to produce within strict limits, declaring quantities online and complying with all regulations.
The Chief Justice emphasized a practical solution, saying, “What is the problem in allowing them to manufacture if they follow norms? Extreme orders will create problems… let them manufacture, but no sale in NCR until further orders.”
The case is part of the broader legal scrutiny on air pollution in Delhi-NCR, which includes concerns over firecrackers and stubble burning. The court’s order reflects an attempt to balance environmental concerns with practical realities for manufacturers while preventing illegal sales and use in restricted areas.
