Bihar SIR: SC Warns EC Entire Revision May Be Scrapped if Illegal Methods Found

Final arguments on Bihar’s SIR validity set for October 7; petitioners allowed to challenge nationwide SIR for broader adjudication.

The Supreme Court on Monday cautioned that the entire Special Intensive Revision (SIR) of electoral rolls in Bihar would be struck down if it is proven that the Election Commission (EC) employed any illegal methodology at any stage of the process. The bench also stressed that its verdict on Bihar’s SIR will have pan-India implications.

The court observed that the EC, as a constitutional authority, is presumed to be acting in accordance with law and mandatory rules. However, it warned that any violation could invalidate the exercise. “Our judgement in Bihar SIR will be applicable for pan-India SIR,” the bench stated, rejecting the idea of giving piecemeal opinions.

Final arguments on the validity of Bihar’s SIR will be heard on October 7. The bench also permitted petitioners challenging the Bihar SIR to extend their submissions to the nationwide SIR, ensuring a comprehensive adjudication.

In the meantime, the court issued notice on a plea seeking recall of its September 8 order, which had directed the poll panel to accept Aadhaar as the 12th prescribed document in Bihar’s SIR. On that day, the apex court clarified that Aadhaar cannot serve as proof of citizenship, but may be used as identification, subject to verification by the EC.

The case assumes significance as Bihar’s SIR exercise is being closely watched, with implications for the accuracy, transparency, and legality of electoral roll revisions across the country.
