The Karnataka High Court has dismissed IPS officer Rupa Moudgil’s petition seeking call data records (CDR) of IAS officer Rohini Sindhoori, terming it unnecessary and irrelevant. Moudgil had filed the plea as part of a defamation suit against Rohini over allegedly objectionable Facebook posts. The Magistrate Court had earlier rejected her request, prompting her to approach the High Court.
A single-judge bench led by Justice Sachin Shankar Magdum noted that seeking CDRs appeared to be a tactic to delay proceedings. The court emphasised that Rohini’s CDR has no connection with the alleged Facebook posts and Moudgil’s current case. Rohini’s lawyer argued that Moudgil repeatedly postponed hearings, and the Magistrate had rightly limited her attempts.
Moudgil’s counsel contended that the CDRs were essential to show Rohini’s alleged contact with Moudgil’s husband, Munish Moudgil, to substantiate her defense. However, the court clarified that ordering CDRs would violate privacy, and any evidence could instead be obtained directly from Munish for examination. The High Court imposed a ₹10,000 fine on Moudgil, giving Rohini a final opportunity for cross-examination.
