No property share for those who neglect parents: KBG

Children or relatives who fail to take care of their elderly parents will lose their right to inherit property, said Minister Krishna Byre Gowda in the Legislative Council. Referring to the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, he stated that wills or gift deeds made in favor of neglectful children can be canceled.
Replying to a question by Council member Balkees Banu, the Minister said, "Many senior citizens are being neglected by their children. The law allows such seniors to revoke any property transfer, including wills or gifts, if they are not looked after."
He emphasized that it is the legal duty of children and relatives to care for their elderly parents, including providing for daily needs and medical expenses. If they fail, seniors can file a complaint under Section 9 of the Act.
If negligence is proven, Section 23 of the Act permits authorities to cancel any will or gift deed, and the property will return to the parent or senior citizen. The Minister also said that sub-divisional officers handle these cases, and district commissioners review appeals. Regular monthly reviews are conducted to ensure action on such complaints.
