HC rejects plea to quash charges
The High Court has rejected a plea to quash the charges against a husband accused of murdering his wife by pushing her from the sixteenth floor of their home.
The petition was filed by Devendra Bhatia, a resident of Yeshwantpur, seeking to quash the charge sheet filed by the RM City police against him. The order was delivered by Justice M. Nagaprasanna, who stated that the allegations against the petitioner appear to be credible.
The court pointed out that there is no reason for children to make such accusations against their father without any basis. Additionally, the court noted that no warrants had been issued in the matter, and thus there was no justification for granting relief to the accused. The details mentioned in the petition seemed to reflect merely the accused's fictional thoughts rather than any substantial evidence.
Background of the Case: In 2018, Devendra Bhatia was accused of murdering his wife by pushing her from their sixteenth-floor apartment, with the complaint filed by their son. Following this, the police at the M.C. Yard station registered a case, submitting the charge sheet for murder and domestic violence to the appropriate court. Devendra later filed a plea in the High Court to quash this charge sheet.
During the proceedings, the defense attorney argued that the accusations were far from the truth, claiming that the wife had accidentally fallen from the balcony. The lawyer contended that it was improbable to assume that a murder had occurred, given the claims made by the son of the accused, who reportedly did not maintain a cordial relationship with his father. Therefore, they contended that the allegations were made in a malicious manner.
On the other hand, the complainant's attorney countered, emphasizing that the allegations were not solely made by the son, as the daughter had also testified against the father. The court, considering all the arguments and evidence presented, ultimately upheld the charges against Devendra Bhatia and dismissed his plea to quash the chargesheet.
