HC issues notice to NHAI over ‘illegal’ toll collection at Nagasandra flyover

The Karnataka High Court has issued notices to the National Highways Authority of India (NHAI) and the Ministry of Road Transport and Highways over allegations of illegal toll collection at the Nagasandra flyover on the outskirts of Bengaluru.

The notice was issued by a division bench comprising Chief Justice Vibhu Bakhru and Justice CM Joshi after hearing a public interest litigation (PIL) filed by Bengaluru-based advocate AV Amarnathan. The court has sought responses from both the central agencies regarding the legality of toll being charged at the location.

In his petition, Amarnathan contended that although the flyover falls within the limits of Bengaluru city, a toll fee of ₹40 is being collected from commuters, including himself, by NHAI. He regularly uses the flyover while travelling from his residence on Huskur Road in Dasanapura hobli of Nelamangala taluk to the city, and believes the toll levy is unjustified and in violation of rules.

Amarnathan alleged that when he approached the NHAI office seeking clarity on the toll collection, officials refused to provide any explanation. Furthermore, his application filed under the Right to Information (RTI) Act seeking details of the toll operations went unanswered, prompting him to approach the High Court.

The petitioner has sought directions from the court to halt what he terms as illegal toll collection and to initiate appropriate action against the officials responsible.

The court's notice marks the beginning of legal scrutiny into the matter, which could have broader implications for toll collection practices within urban limits. The matter has been posted for further hearing in due course. Meanwhile, the High Court has directed the respondents to file their replies.
