HDFC Insurance Company Penalised

The District Consumer Grievances Redressal Commission has slammed the HDFC Ergo Insurance Company for its deficiency in providing service to the customer.
Allabaksh Mulla of Anand Nagar in Hubli had approached the commission seeking justice. His son Aseef Mulla had taken a Sarva Suraksha policy from the Insurance company for the assured amount of Rs 10 lakh and had paid a premium of Rs 7,646. He had made his father Allabaksh as the nominee.
On December 12, 2019, Aseef died in an accident near Hulkoti in Gadag district. A case had been registered against the driver, who drove the lorry which hit Asif’s bike, at Gadag Police station. Allabaksh then approached the company producing all relevant documents seeking payment of the assured amount to him as he was the nominee.
However, the Insurance Company refused Allabaksh’s claim and paid Rs 10 lakh to Aseef’s wife Noorjahanbi. Questioning this, Allabaksh approached the District Consumer Grievances Redressal Forum. In his petition, he had said that the company should have paid him the amount, as he was the nominee and denying his claim was a lapse on the part of the company in providing service.

The commission headed by Ishappa Bhute heard the plea and upheld his argument. It has ordered the insurance company to pay the petitioner Rs 10 lakh which is the claim amount. In addition, it directed the company to pay a compensation of Rs 50,000 as compensation for the mental agony caused to the petitioner and Rs 5,000 towards court expenses within a month. It said in case of delay in payment, interest at the rate of 8 percent  should be added.
