DoT unveils draft spectrum allocation rules framework

The Department of Telecommunications (DoT) has released draft rules outlining the framework for administrative allocation of spectrum under the Telecommunications Act, 2023, marking a significant step towards streamlining spectrum management for telecom operators, government entities and satellite communication service providers.

The proposed regulations establish eligibility criteria, spectrum assignment procedures, usage conditions and fee structures for services that qualify for spectrum allocation through administrative mechanisms rather than auctions. The framework is expected to benefit public sector telecom operators, satellite communication providers and various specialised communication services.

Under the draft rules, state-owned telecom companies Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL) are among the entities eligible for spectrum assignments under administrative provisions. The framework also covers satellite-based communication services, which have gained increasing importance with the expansion of broadband connectivity and emerging space-based communication technologies.

The proposed regulations specify that eligible entities will be required to pay spectrum charges determined by the government. The charges will be based on factors such as frequency bands, service categories, coverage areas and intended usage. The rules also define conditions relating to spectrum utilisation, interference management, compliance obligations and renewal procedures.

A key objective of the draft framework is to provide regulatory clarity for satellite communication operators seeking access to spectrum. The move is expected to facilitate the growth of satellite broadband, remote connectivity solutions and other emerging digital communication services across the country.

The Telecommunications Act, 2023, introduced provisions allowing administrative spectrum allocation for specific categories of services where auction-based assignment may not be appropriate. These include national security applications, public interest services, disaster management communications and certain satellite-based services.

Industry stakeholders, telecom operators and satellite service providers have been invited to submit comments and suggestions on the draft rules before they are finalised. The consultation process aims to ensure that the framework balances efficient spectrum utilisation with the growing demand for advanced communication services.

The proposed rules are expected to play an important role in supporting India’s digital connectivity goals, promoting innovation in satellite communications and providing a transparent mechanism for spectrum allocation across eligible service categories.
