Flat owners seek clear norms for forming associations

The owners are demanding to formulate regulations in order to protect the residents in flats

Owners of several apartment projects developed by Bangalore Development Authority (BDA) have submitted a joint representation to the statutory body, seeking a clear procedure for forming resident associations. In their letter to the BDA Chairman, they said the authority’s officials are now advising allottees to form associations to handle daily maintenance and housekeeping. While owners welcomed the move, they pointed out that the authority has not issued any framework or reference document detailing how such associations should be formed in the BDA housing complexes. The absence of a defined procedure, they said, has led to confusion on the ground. Different groups of residents are following their own interpretation of the process, leading to disagreements and friction within communities. Even BDA officials, the representation noted, often rely on informal methods due to the lack of standard guidelines.

There is confusion over which Act to register under, what responsibilities the association must take over, and how the handover (of houses) from BDA should happen… This ambiguity has led to conflicts among residents, repeated elections, and disagreements over the 1972 Act versus the Societies Act. Without a standard process, even registered associations in other BDA apartment complexes are struggling with what handover actually means. The BDA flat residents urged the authority to issue standard guidelines or a notification specifying the legal basis for registering associations, roles and responsibilities, election procedures and the transition process from the BDA management to an owners’ association. They also requested BDA to appoint a nodal officer for each cluster to ensure consistency.

Reacting to this, BDA Chairman, MLA NA Harris said, we will be coming up with guidelines in the next 2 months for forming associations. It’s important that these buildings are run the same way private developers maintain their projects.
