According to the official memorandum No. Administration/23/2026-27 dated June 11, 2026, issued by the Commissioner of Health and Family Welfare Services, Bengaluru, Dr Patel, a specialist doctor, was transferred from the Government Hospital at Basavana Bagewadi to the Government Public Hospital at Bilagi in Bagalkot district under Category 6(2) on public-interest grounds. However, despite the transfer order, Dr Patel allegedly did not report to the new place of posting and continued to discharge duties at his existing workplace.
As per normal administrative procedure, once a government employee is transferred, the employee is expected to report to the new place of posting first. If the employee has genuine reasons for wanting to remain at the previous place, he or she can subsequently submit an appeal or representation to the competent authority. The competent authority can then examine the representation and decide whether the employee should be retained, transferred elsewhere or continue at the new posting. In this case, questions are being raised as to why Dr. Patel allegedly continued at his old posting without joining the transferred place.
The controversy has deepened because the Vijayapura District Health and Family Welfare Office reportedly cited a telephone instruction from the Private Secretary to the Health Minister, directing that Dr. Patel continue at his present place until another specialist was posted there.
Can a formal transfer order issued by the Commissioner be kept in abeyance on the basis of a telephone instruction?If such instructions are sufficient to override written government orders, questions arise over the authority and effectiveness of formal administrative orders.
The role of Health Department Commissioner Gurudatta has also come under scrutiny. It is alleged that Commissioner Gurudatta was aware of the issue and the circumstances surrounding Dr Patel’s transfer and continuation at the old posting. However, critics allege that no decisive action has been taken so far.Questions are therefore being raised over why the senior-most administrative authority has remained silent despite being aware of the alleged non-compliance with the transfer order.
The controversy has raised a larger question about the functioning of Health Department: If official orders can remain unimplemented despite the knowledge of senior authorities, who is accountable for enforcing government decisions.
